Who these terms are with

What Liftitude is

Liftitude is a personal performance system for recording training, wellness, nutrition and route activity. It is early-release software offered free of charge. It is a self-tracking tool, nothing more.

Liftitude is not a medical device and gives no medical, nutritional, fitness or other professional advice. Nothing it displays is a diagnosis, a treatment recommendation or a training prescription. Talk to a qualified professional before making decisions about your health or training, and never disregard professional advice because of something you read here.

Using the service

  • You need a Google account to sign in. You are responsible for keeping that account secure; anyone who can sign in to your Google account can reach your Liftitude account.
  • You are responsible for the content you enter and for making your own copies of anything you would not want to lose.
  • Do not use Liftitude unlawfully, do not attempt to reach other users' data, and do not attack, overload or probe the service beyond normal use.
  • Do not attempt to circumvent rate limits, authentication or other technical controls.

Your content

What you record stays yours. We claim no ownership of it. Most of it never reaches our servers at all — it stays in your browser. For the limited data we do store online, we use it only to operate the service for you, as described in the privacy policy.

Availability and changes

Liftitude is provided on an “as is” and “as available” basis. There is no uptime commitment and no service-level guarantee. We may change, suspend or withdraw any part of the service, including the whole service, at any time and without notice. Features may be added, altered or removed as the product develops.

Ending your account

You can delete your online account at any time from Settings → Account, or follow the deletion instructions. Deletion is immediate and cannot be undone.

We may suspend or terminate access if an account is used to break these terms, to break the law, or in a way that threatens the service or other users. Where it is reasonable to do so, we will say why.

Warranties and liability

To the fullest extent permitted by law, Liftitude is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that data stored in your browser will survive changes you or your browser make to that storage.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary loss, or for any loss of data, profits, or goodwill, arising from your use of or inability to use Liftitude.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

Governing law

A governing jurisdiction has not been established for this deployment, because the legal operator has not yet been confirmed. This section will state the governing law once that identity is settled. Until then, no choice of law or forum is asserted.

Changes to these terms

These terms may change as Liftitude develops. The revision date at the top of the page changes when they do. Continuing to use the service after a change means you accept the revised terms.
